OMP’s Tax Practice Successfully Represented Leading International Pharmaceutical Group in Dispute with Ukrainian Tax Authorities

OMP’s tax litigation team successfully defended the interests of a leading international pharmaceutical group in a high-stakes dispute with the tax authorities of Ukraine.

The team of tax litigators, led by Partner Mykola Orlov, secured a favourable court ruling confirming the legitimacy and economic substance of the marketing services provided to the pharmaceutical manufacturer by pharmacy chains and procured through a professional intermediary.

OMP lawyers Mykola Orlov and Andriy Kachkovskyi also convincingly demonstrated the clear and direct link between the acquired services and the company’s core business activities.

This court decision sets an important precedent for safeguarding the rights of pharmaceutical companies against arbitrary actions by tax authorities, which have increasingly sought to deny manufacturers and importers the right to VAT reimbursement and impose additional corporate profit tax and VAT liabilities without proper justification.

Our experts emphasize that meticulous documentation of pharmacy marketing activities is essential for effectively protecting the interests of pharmaceutical companies in tax disputes.
