OMP’s tax litigation team successfully defended the interests of a leading international pharmaceutical group in a high-stakes dispute with the tax authorities of Ukraine.
The team of tax litigators, led by Partner Mykola Orlov, secured a favourable court ruling confirming the legitimacy and economic substance of the marketing services provided to the pharmaceutical manufacturer by pharmacy chains and procured through a professional intermediary.

This court decision sets an important precedent for safeguarding the rights of pharmaceutical companies against arbitrary actions by tax authorities, which have increasingly sought to deny manufacturers and importers the right to VAT reimbursement and impose additional corporate profit tax and VAT liabilities without proper justification.
