Dear Ladies and Gentlemen,
The legal team at Law Offices of OMP successfully secured the removal of a pharmaceutical product of an international pharmaceutical company from the list of medicines prohibited for advertising. This achievement was led by Partner Ihor Ohorodniiuchuk and executed by Senior Associate Nataliya Mozhova.
Previously, legislative amendments were adopted regarding the criteria used to determine which medicines are prohibited from advertising. Based on these changes, the list of medicines prohibited for advertising was reviewed.
The company’s product, however, remained on the list despite the absence of valid legislative grounds. Following the submission of a well-reasoned request prepared by Law Offices of OMP, the Ministry of Health of Ukraine successfully removed the medicine from the list of products prohibited for advertising.
These amendments aim to ensure proper implementation of regulations governing the advertising of over-the-counter medicines and to promote fair competition in the pharmaceutical market.
According to Law Offices of OMP experts, this case also sets an important precedent for establishing a positive practice of efficient and constructive cooperation between market players and state authorities.
